A New Declaration

by Tim McDonough, April 14, 2007

When in the course of human events it becomes necessary for a people to impeach their elected President, even when the legality of his election is questionable, a decent respect for the opinions of their fellow citizens and for the opinions of all the peoples of the world, requires that they should declare the causes .

We as a people have previously declared and by our endeavors throughout the existence of our nation have sought to promote these truths as self-evident: that all people are created equal and have certain unalienable rights, among which are life, liberty and the pursuit of happiness. It is to secure these rights that our government was formed and it is only through our consent that our government derives its power. Whenever the President through his actions becomes destructive of these ends, it is our right to remove him from office in order to ensure the safety of our nation as well as our happiness. Prudence dictates that governments should not be changed for light and transient reasons. And, we know through long experience that we are more disposed to suffer evils that are sufferable than to pursue what is right. But when a long train of abuses and usurpations demonstrates acts of malfeasance and despotism, it is our right, it is our duty, to throw off the President and provide new guards for our future security. Such has been our patient sufferance and such is now our necessity. The history of the President George W. Bush is a history of repeated injuries, usurpations, and gross mismanagement that have put the security of this nation and its people at grave risk and have approached levels of malfeasance and tyranny that are not acceptable to a free and democratic people. To prove this, let the facts be submitted to a candid world.

He has declared war and sent our troops in harms way by deliberating misleading the people and the Congress regarding the threat posed by Iraq. By lying to Congress, he has violated the laws of United States: Fraud and False Statements: Title 18, Chapter 47, Section 1001 and Conspiracy to Defraud the United States, Title 18, Chapter 19, Section 371.

  1. He declared in his State of the Union Address based on evidence that he knew was at best doubtful: "The British Government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa."
  2. He led people to believe that Iraq was involved with 9/11 by repeatedly linking them in his speeches even though he knew this was not true.
  3. He stated that Congress had access to all the same information that the White House had. But he was briefed many times about the falsehood of various stories and never gave this information to Congress.
  4. He said that aluminum tubes Iraq attempted to buy were intended for use in a uranium centrifuge to create nuclear weapons, but this evidence had been rejected by the Department of Energy and other intelligence agencies long before he used them in his speeches.
  5. He said there was a "relationship" between Iraq and Al Qaeda despite all evidence and reasonable supposition to the contrary, such as the fact that Saddam led a secular government while one of Al Qaeda’s primary goals is the establishment of an extreme form of Islamic government and the destruction of secular government. He continued to maintain this deception even after the 9/11 Commission released a report stating that there was no "collaborative relationship" between Al Qaeda and Iraq.
  6. He insisted that Iraq possessed weapons of mass destruction even though the United Nations was on the ground in Iraq and could find nothing and the best evidence he could produce were questioned by many authorities. He maintained this deception well after extensive searches by our own troops produced no evidence of such weapons and only admitted his deception when it was no longer possible to maintain the slightest thread of credibility.
  7. He claimed that Iraq possessed mobile weapons labs capable of producing anthrax knowing that the only source for these claims was unreliable. He had his Ambassador to the United Nations, Colin Powell, showed diagrams of these purported weapons before the UN to justify invading Iraq. For over a year after a U. S. team of bio-weapons experts examined the trailers and concluded they were simply designed to produce hydrogen for weather balloons, he suppressed the report of the experts and continued to claim the trailers were part of Iraq's bio-weapons program.
  8. He created a secret team in the Pentagon, the Office of Special Plans to rewrite the official intelligence reports of the CIA and to manufacture their reports using whatever evidence they could gather no matter how unreliable.
  9. He has for strictly personal and political reasons declassified those select portions of a classified National Intelligence Estimate that supported his viewpoints while keeping classified those portions that contradicted his viewpoint in order to shape public opinion.

He has waged war with Iraq without a congressional declaration of war or equivalent act thus violating the War Powers Clause of the United States Constitution.

He mismanaged the war in Afghanistan thereby failing to achieve the primary goal of capturing Osama Bin Laden and eliminating Al Qaeda.

He abandoned the war in Afghanistan to pursue an invasion of Iraq creating a dangerous and unstable situation that will require continued commitment of our troops and those of other countries.

He failed to properly assess the likely outcomes of an invasion of Iraq.

He failed to properly plan for the invasion of Iraq and did not provide sufficient troops to assure success once the government of Iraq was overthrown.

He has mismanaged the war in Iraq increasing the power of Al Qaeda and other countries that are unfriendly to the United States. These actions have made an area of the world critical for our energy supply unstable and put our nation at substantial economic risk.

He failed to properly prepare and provision our troops for the invasion and occupation of Iraq.

He mismanaged the reconstruction of Iraq with little to show for billions of dollars spent and resulting in extremely excessive overcharging and corruption by his hand-selected corporations from which he and his team have profited from in the past and stand likely to profit from again in the future.

He has not only condoned the torture of prisoners but has taken actions to promote it, violating both the War Crimes Act and the Federal Torture Act.

  1. He signed an order declaring members of the Taliban and Al Qaeda unlawful combatants and thereby not covered by the Geneva Conventions. This act can be traced to a memo from the White House Counsel, Alberto Gonzales that advises the President to invent a technicality in order to reduce the chance of prosecution.
  2. He moved prisoners to Gauantanamo Bay in Cuba in order to avoid granting them the rights and protections provided by U.S. laws.
  3. He set up secret prisons in foreign lands that are known for torturing prisoners and has these prisons run by the CIA.
  4. He has refused to take action when informed by the General Council of the United States Navy, Alberto Mora, of cruel behavior toward terror suspects.
  5. He formally stated his intentions to ignore any provisions against torture in October 2005 in his signing statement to a defense bill to which Senator McCain added an amendment to outlaw torture.

He has authorized the National Security Agency to conduct warrentless wiretaps on United States citizens.

He has been negligent and slow to respond to help the victims of Hurricane Katrina.

He has condoned the removal of Officers of the Law for political reasons.

He has committed war crimes in the invasion of Iraq by violating international laws, the U. N. Charter and the Nuremberg Laws, when the Constitution of the United States expressly states that international treaties are the supreme law of the land.

He has asserted broad executive powers attributing them to his position as Commander in Chief and the “war on terror” that in essence combine the powers of all three branches of government in a single individual in direct contradiction to the text of the United States Constitution.

He has created an environment of disrespect for the law and the constitution.

We, the people of the United States of America, seeking to preserve our unalienable rights, uphold the laws of our land, maintain respect for ourselves and regain the respect of all the peoples of the world, do solemnly publish and declare that George W. Bush is unfit to be President and that all political connection between him and the United States of America ought to be totally dissolved. We call upon all of our representatives in both houses of Congress to proceed immediately with impeachment
